TERMS OF USE FOR THE AI ADVANTAGE HUB
These Terms of Use ("Terms") govern your enrollment in and participation in the AI Advantage Hub ("Hub" or "Program") offered by Gandia Communications, Inc. ("Company," "we," or "us"). By purchasing or participating in the Hub, you ("Member," "you," or "your") agree to these Terms. If you do not agree, do not enroll or participate.
- Program Overview
The AI Advantage Hub is a monthly membership program designed to help freelance writers and solo marketers stay current with AI developments, sharpen their workflows, and maintain a strategic edge through curated resources and expert guidance.
Membership includes access to:
- Weekly playbooks and workflows
- The AI Signals Brief
- Strategic resources and templates
- Ed on Tap AI coaching (at no additional charge)
- Monthly Strategic Problem-Solving Sessions
- A private Hub Exchange community hosted on Thinkific
- Expert feedback and insights provided within the community
These elements, together with all related content, materials, templates, and updates, are referred to as the "Services" or "Hub Materials."
- Ed on Tap AI Coaching Service
2.1 Service Description Ed on Tap is an AI-powered coaching assistant designed to provide business guidance and support. It is included with your Hub membership at no additional charge and is hosted on the Coachvox platform.
2.2 Important Disclaimers - Please Read Carefully
NOT A REAL PERSON: Ed on Tap is an artificial intelligence system, not a human being. It does not possess emotions, professional qualifications, licenses, or the ability to understand context the way a human does.
NOT PROFESSIONAL ADVICE: Ed on Tap is NOT intended to provide and does NOT provide:
- Legal advice or legal guidance
- Medical advice or health recommendations
- Mental health counseling or therapy
- Financial planning or investment advice
- Tax advice or accounting guidance
- Professional licensing or regulatory compliance advice
For any of these matters, you must consult with appropriately licensed professionals.
USE AT YOUR OWN RISK: By using Ed on Tap, you acknowledge that you are doing so at your own discretion and risk. You understand that AI responses may contain errors, inaccuracies, or "hallucinations" (incorrect or nonsensical information).
NO GUARANTEES: We make no guarantees about the accuracy, completeness, or reliability of any information provided by Ed on Tap. You are solely responsible for evaluating and acting upon any guidance received.
2.3 Data Handling for Ed on Tap
Ed on Tap is hosted on the Coachvox platform. Your interactions with Ed on Tap are subject to both our privacy policy and Coachvox's data handling practices. Key points you should understand:
Data Controllers: According to Coachvox's terms, conversation content between you and Ed on Tap is jointly controlled by both Coachvox and us. Your account information is controlled by us, with Coachvox acting as a data processor.
Data Usage: Conversation data may be used for service delivery, quality assurance, and AI model improvement.
International Transfers: Your data may be transferred to and stored in countries outside the UK or European Economic Area, including the United States, with appropriate safeguards in place.
Confidentiality: While we treat your conversations as confidential, they may be accessed by our team and Coachvox when necessary to deliver or improve the service and provide support.
Data Retention: We retain your Ed on Tap conversation data only as long as necessary to provide services and comply with legal obligations.
Important: Do not share highly sensitive personal information, financial details, health information, or confidential business data in your Ed on Tap conversations.
You consent to this data processing arrangement by using Ed on Tap. You may request deletion of your conversation data by contacting us at support@b2blauncher.com.
2.4 Platform Responsibility We are not responsible for any technical issues, downtime, errors, or problems with the Coachvox platform that hosts Ed on Tap. While we strive to provide reliable access, the AI service is provided "as is" without warranties of any kind.
- Eligibility and Conduct
Age Requirement: You must be 18 years or older to participate.
Lawful Use: You agree to use the Hub for lawful purposes only and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Hub.
Conduct: You agree not to post or transmit any content that is unlawful, abusive, harassing, defamatory, obscene, or otherwise objectionable within the community or to any other member.
AI Misuse: You agree not to attempt to make Ed on Tap generate hateful, illegal, offensive, or inappropriate content.
- Intellectual Property and License
Our Materials: All Hub content, including but not limited to videos, PDFs, workflows, prompts, templates, written materials, logos, and trademarks ("Hub Materials"), belong to us or our licensors and are protected by intellectual property laws.
License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use the Hub Materials for your personal and internal business use only, for as long as your membership remains active and in good standing.
Restrictions: You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, sell, or otherwise exploit the Hub Materials for commercial purposes or share them with non-members.
No Sharing: Sharing login credentials or any Hub content with non-members is strictly prohibited and grounds for immediate termination without refund.
- Payment and Subscription Terms
Subscription Fee: The current monthly fee ("Subscription Fee") is displayed at checkout and will be automatically billed to your payment method each month until canceled.
Automatic Renewal: Your membership will automatically renew each month unless canceled in advance of your next billing cycle.
Founding Member Rate: If you joined under a founding member promotion, your discounted rate will be honored for as long as your membership remains active. If you cancel and later rejoin, the standard Subscription Fee in effect at that time will apply.
Billing Authorization: By providing your payment method, you authorize us to charge your card on a recurring monthly basis for the Subscription Fee until you cancel.
- Cancellation and Refund Policy
Cancel Anytime: You may cancel your membership at any time by logging into your account and following the cancellation instructions. No phone call or email is required.
15-Day Satisfaction Guarantee: If within the first 15 days of your membership you are not satisfied, you may request a full refund by emailing support@b2blauncher.com. After the first 15 days, no refunds are issued for any reason.
Post-Cancellation Access: When you cancel, your membership will remain active through the end of your current billing period. After that, your access to all Hub content, Ed on Tap, and community features will be revoked automatically. No prorated refunds will be issued for partial months.
- Community Participation
Platform: The Hub's private community is hosted within the Thinkific platform.
Optional Participation: Community engagement is optional but strongly recommended to gain the full benefit of the Program. Participation is subject to the same conduct expectations outlined in Section 3.
Moderation Rights: We reserve the right to remove any member from the community for inappropriate conduct, with or without notice.
- Media Release and Recordings
Recordings: Any live Q&A sessions, community office hours, or similar interactive events may be recorded. By participating, you consent to being recorded and grant us the right to use your contributions within the Hub's platform for other members to view.
Use Limitations: Recordings will not be shared publicly outside the Hub without your explicit permission.
- AI Use Policy
We may use AI tools to enhance elements of our business and support client work, including but not limited to content generation, editing, and ideation. Our AI use is guided by the following principles:
- Human-First: AI supports our work but does not replace our expertise or human judgment.
- Privacy-First: We anonymize or withhold sensitive information when using AI tools.
- Accuracy & Oversight: AI outputs are carefully reviewed and edited before sharing with members.
- Limitations: AI is not used for decision-making or storing sensitive client data. All AI tools used are subject to our internal vetting.
We currently use ChatGPT's Team Plan, which includes enterprise-grade privacy protections and SOC 2 compliance. Our policy is reviewed at least annually or as needed.
- Disclaimers
Educational Use Only: The Hub and Ed on Tap are designed for informational and educational purposes only. They are not substitutes for professional legal, financial, medical, or mental health advice.
No Guarantees: We do not guarantee specific outcomes, earnings, or results from using the Hub or Ed on Tap. Your results depend on your own efforts, background, and application of the material.
Illustrative Examples Only: Any success stories or results shared are illustrative and do not guarantee similar results for you.
AI Limitations: Ed on Tap may generate incorrect, misleading, or nonsensical information. These "hallucinations" are a limitation of current AI technology over which we have no control.
- Limitation of Liability
To the maximum extent allowed by law:
- We will not be liable for any indirect, special, consequential, or incidental damages arising out of your participation in the Hub or use of Ed on Tap, including but not limited to lost profits, revenue, data, or goodwill.
- Our total liability under these Terms is limited to the amount you have paid in Subscription Fees in the 12 months prior to the claim (or $100 if none).
- You assume full responsibility for your own actions, decisions, and results based on any guidance received from the Hub or Ed on Tap.
- We are not liable for any technical issues, errors, or downtime related to the Coachvox platform that hosts Ed on Tap.
- Indemnification
You agree to indemnify and hold harmless the Company, its officers, employees, agents, and affiliates from any claims, losses, liabilities, damages, or expenses (including attorneys' fees) arising from your participation in the Hub, your use of Ed on Tap, your misuse of content, or your violation of these Terms.
- Dispute Resolution and Arbitration
Informal Resolution: In the event of a dispute, you agree to first attempt to resolve it informally with us via email or call.
Binding Arbitration: If unresolved, both parties agree to submit the matter to binding arbitration in Cherokee County, Georgia, under American Arbitration Association rules.
Time Limit: Any claims must be brought within one (1) year of the alleged issue or are waived.
- Termination
By You: You may cancel your membership at any time. Your access to the Hub and Ed on Tap will continue through the end of your current billing period, after which it will be automatically revoked. Refunds are subject to the 15-day policy described in Section 6.
By Us: We reserve the right to suspend or terminate your membership for any violation of these Terms, with or without notice.
- Miscellaneous
- Severability: If any provision is found unenforceable, the remainder remains in full force.
- Assignment: You may not transfer your membership or rights without our written permission.
- Entire Agreement: These Terms and our Privacy Policy represent the full agreement between you and us regarding the Hub.
- Governing Law: These Terms are governed by the laws of the State of Georgia, USA.
