These Terms of Use ("Terms") govern your enrollment in and participation in the "21 Days to Building a Powerful and Sustainable Prospecting Habit" workshop ("Workshop") offered by Gandia Communications, Inc. ("Company," "we," or "us"). By purchasing or participating in the Workshop, you ("Client," "you," or "your") agree to these Terms. If you do not agree, do not enroll or participate.

1. Program Overview

1. 1. The 21-Day Prospecting Workshop is an interactive online training workshop designed to help freelance writers, copywriters, publicists, and solo marketing professionals develop and implement a systematic prospecting system and build sustainable prospecting habits.
   2. It includes daily video lessons, homework assignments, personalized feedback, and access to a private Slack community workspace (collectively, the "Services").

2. Eligibility and Conduct

1. 1. Age Requirement: You must be 18 years or older to participate.
   2. Professional Experience: This Workshop is designed for writers, copywriters, publicists, and solo marketing professionals who are already working with paying clients. You do not need to be at any particular income level, but you must already be generating some freelance income to benefit from the Workshop.
   3. Lawful Use: You agree to use the Workshop for lawful purposes. You must not engage in any behavior that disrupts the Workshop or violates any laws.
   4. Conduct: You will not post or transmit any content that is offensive, abusive, defamatory, obscene, or otherwise objectionable or unlawful in the Slack workspace or any other Workshop platform.

3. Intellectual Property and License

1. 1. Our Materials: All Workshop content, including videos, PDFs, written materials, templates, protocols, logos, and trademarks ("Workshop Materials"), belong to us or our licensors and are protected by intellectual property laws.
   2. Limited License: We grant you a non-exclusive, non-transferable license to access and use the Workshop Materials for your personal and internal business use only, during your active participation and according to these Terms.
   3. Restrictions: You may not copy, reproduce, distribute, share, publish, sell, or otherwise exploit any Workshop Materials for commercial or non-personal use without our express written consent.
   4. Prohibited Sharing: Sharing your Workshop login credentials or Workshop Materials (in whole or in part) with unauthorized individuals is strictly prohibited and may result in immediate termination of your access.

4. Payment Terms

1. 1. Fees: The Workshop fee is $295 ("Fee"). You agree to pay all Fees when due.
   2. Authorization: By providing a payment method, you authorize us to charge your card on file for the agreed-upon Fee.

5. Refund Policy

1. 1. Refund Eligibility: We guarantee that you're going to get a ton of value from this Workshop. However, if after completing our 21 days together (and once you've participated in all the lessons) you feel that the Workshop didn't meet your expectations, simply email us at support@b2blauncher.com, show us that you did all your work, and we'll quickly refund your entire tuition.
   2. Participation Requirement: We do not offer refunds for non-participation. You have to complete the entire program and do the daily work to qualify for a refund. That's the only way we can be fair to all Workshop participants.
   3. Emergency Deferrals: This is the final offering of this Workshop. No deferrals to future sessions are available.
   4. How to Request a Refund: To request a refund, you must email support@b2blauncher.com with documentation of your completed work and your request.

6. Program Access and Duration

1. 1. Schedule: The Workshop runs for 21 consecutive weekdays (Monday through Friday only), with daily video lessons and homework assignments. No new lessons or homework are released on weekends, though optional 3-minute inspirational audios are provided on Saturdays and Sundays.
   2. Daily Time Commitment: Your daily time commitment will typically be 30-60 minutes every weekday for going through the daily video lesson and completing the assigned homework exercise. Some participants may spend more time depending on the lesson content and how thoroughly they choose to implement the exercises.
   3. Slack Community: You will have access to a private Slack workspace throughout the 21-day Workshop and for an additional period beyond the Workshop end date, as specified during your enrollment.
   4. Lifetime Access: After the Workshop concludes, you will receive lifetime access to all Workshop materials and resources through a dedicated training portal.
   5. Asynchronous Participation: All lessons are pre-recorded and can be accessed at your convenience. The Workshop is specifically designed to accommodate participants from all time zones and varying schedules.

7. Media Release and Recordings

1. 1. Slack Participation: You acknowledge that your participation in the Slack workspace, including any comments, questions, homework submissions, or other contributions, may be viewed by other Workshop participants and the instructor.
   2. Consent to Community Sharing: By participating in the Slack workspace, you consent to sharing your progress and contributions with the Workshop community as part of the accountability and support structure.
   3. Privacy Considerations: While the Slack workspace is private to Workshop participants only, you should be mindful of what personal or business information you choose to share.
   4. Content Usage: We reserve the right to use anonymized examples of participant questions, challenges, or successes for educational purposes in future Workshop materials or marketing, but will not attribute such examples to you without your express permission.

8. Disclaimers

1. 1. Educational Purpose Only: The Workshop is provided for educational and informational purposes. We do not guarantee specific financial, business, or other outcomes.
   2. No Professional Advice: The Workshop does not substitute for legal, financial, or medical advice. Always consult qualified professionals regarding any specific legal, financial, or health situation.
   3. No Guarantees / Earnings Disclaimer:
      • We do not make any guarantees about future earnings or income. Any examples or success stories are illustrative and do not guarantee you will achieve similar results.
   4. Your level of success depends on your effort, skillset, dedication, implementation of the strategies taught, and your existing business situation. You agree we are not responsible for your decisions or any subsequent results.
   5. Results from prospecting efforts will vary based on your industry, target market, implementation consistency, and numerous other factors beyond our control.

9. AI Policy

Purpose of AI Use

• We use AI tools to support specific aspects of our business, such as:
  • Assisting with copy creation for our own marketing campaigns.
  • Generating and editing our own editorial content (newsletters, podcast show notes, etc.).
  • Supporting client work by brainstorming ideas, identifying potential solutions, and refining participant-submitted content for clarity and effectiveness.
• AI is a tool to enhance our work, but the final ideas, recommendations, and decisions are always shaped by our experience, expertise, and discernment.

Core Principles and Values

1. Human-First Approach: Participants are always working with us as their instructor. AI is only used to support, not replace, our expertise.
2. Privacy: We protect participant confidentiality by avoiding sharing sensitive details with AI tools and anonymizing data whenever necessary.
3. Accuracy: We carefully review and rewrite AI outputs as needed to ensure they meet our high standards.

Limitations on AI Use

• AI is never used to replace personal interactions with participants.
• AI is only used for specific tasks, such as brainstorming or content support, and never for decision-making.
• AI does not process or store sensitive participant information.
• All AI outputs are reviewed and refined by us before being shared with participants.
• AI is not used to create final Workshop materials without thorough human oversight.

Privacy Commitments

• We do not share sensitive participant information with AI tools.
• If AI could assist with a sensitive matter you are working on, we will obtain your permission before using an AI tool.
• We use ChatGPT's Team plan, which offers robust privacy and security features, including data confinement (data is not used for model training) and SOC 2 compliance with encryption at rest and in transit.

10. Limitation of Liability

1. 1. No Liability for Damages: To the fullest extent permitted by law, we will not be liable for indirect, consequential, or special damages, including lost profits, arising from your participation in the Workshop.
   2. Maximum Liability: Our total liability to you is limited to the total Fee you have paid for the Workshop ($295).
   3. Assumption of Risk: You assume all risks from participating in the Workshop and understand that individual outcomes vary based on implementation, market conditions, and numerous other factors.

11. Indemnification

You agree to defend, indemnify, and hold us (including our officers, employees, contractors, agents, and affiliates) harmless from any claims, liabilities, losses, damages, judgments, or expenses (including attorney's fees) arising out of or related to your participation in the Workshop, breach of these Terms, or misuse of Workshop Materials.

12. Dispute Resolution and Arbitration

1. 1. Good-Faith Efforts: If a dispute arises, both parties agree to attempt to resolve it informally through email or phone discussion.
   2. Binding Arbitration: If we cannot resolve the dispute, both parties agree to submit the matter to binding arbitration in accordance with the American Arbitration Association rules.
   3. Location and Fees: Arbitration will occur in Cherokee County, Georgia, USA, with costs shared by both parties. The arbitrator's decision is final and may be entered in any court of competent jurisdiction.
   4. Six-Month Limitation: Any claim must be brought within six (6) months from the date the dispute arises; otherwise, it is waived.

13. Termination

1. 1. By You: You may withdraw from the Workshop at any time by emailing support@b2blauncher.com, but refunds are subject to the policy in Section 5.
   2. By Us: We reserve the right to terminate or suspend your access if you fail to meet payment obligations, violate these Terms, or engage in disruptive behavior in the Slack workspace.
   3. Post-Termination: Upon termination, your access to Workshop Materials and the private Slack workspace ends immediately. All disclaimers, limitations of liability, confidentiality obligations, and dispute resolution provisions survive termination.

14. Miscellaneous

1. 1. Severability: If any provision of these Terms is found unenforceable, the remainder remains in effect.
   2. Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent.
   3. Entire Agreement: These Terms, along with our Privacy Policy and any written enrollment agreement, constitute the entire agreement between you and us regarding the Workshop.
   4. Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
   5. Updates to Terms: We reserve the right to update these Terms as needed. Any changes will be posted and take effect for future Workshop participants.
